    2. Under the Promotion, if an Eligible Client does not consider that they have received value from our services (pursuant to the relevant Engagement Agreement) at any time during  their Engagement Period (as defined below) prior to entering into a binding contract to purchase a property, we will refund the $50 (incl. GST) retainer fee paid to us under the relevant Engagement Agreement, subject to these Promotion Terms.
    3. These Promotion Terms do not exclude, restrict or modify, any rights or remedies a client may have under the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other law that cannot be excluded.
  1. Promotional Period and Quota Cap
    1. The Promotion is available commencing at 12:00am (AEST) on 1 November 2026 and ending at 11:59pm (AEST) on 30 November 2026 (Promotional Period) unless exhausted earlier pursuant to clause 2.3.
    2. We may withdraw or vary the Promotion at any time prospectively, but any variation or withdrawal will not affect Eligible Clients who have already entered into an Eligible Agreement during the Promotional Period, unless required by law.
    3. The Promotion is subject to a strict numerical cap of 20 Eligible Clients (Quota Cap). The Promotion will automatically close prior to the expiry of the Promotional Period once 20 clients have entered into Eligible Agreements accepted by us. We reserve the right to close the Promotion upon reaching this Quota Cap.
  1. Eligibility
    1. Clients who meet the following eligibility criteria (Eligibility Criteria) during the Promotional Period will automatically participate in the Promotion, subject to availability under the Quota Cap:
      • Quota Allocation: The client is one of the first 20 clients to execute an Eligible Agreement that is accepted and countersigned by us during the Promotional Period.
      • New client: The client has not previously engaged us, or any related entity of ours, for buyers agency services in the 24 months prior to the commencement of the Promotional Period (unless we agree otherwise in writing).
      • Engagement: The client enters into our standard written buyers agency services engagement agreement in the current form (Engagement Agreement), which is expressly identified by us as participating in the Promotion (Eligible Agreement).
      • Timing: The Eligible Agreement is signed by the client and accepted by us during the Promotional Period.
      • Retainer paid: The client has paid the $50 (incl. GST) retainer in cleared funds in accordance with the Eligible Agreement.
      • Property type and location: The search brief relates to primary place of residences or holiday homes only.
      • Client conduct: The client complies with the Eligible Agreement and these Promotion Terms, including attending agreed inspections, providing timely instructions, and acting reasonably and in good faith throughout the Engagement Period.
    2. We may decline to apply the Promotion to any proposed engagement where we reasonably consider that:
      1. the Quota Cap has already been achieved;
      2. the client does not meet, or is unlikely to meet, the Eligibility Criteria; or
      3. the proposed search brief or circumstances are inconsistent with the nature or purpose of the Promotion.
    3. Quota allocation will be determined strictly in order of receipt of a fully signed Eligible Agreement and cleared payment of the $50 retainer (incl. GST). We will provide written confirmation to the client upon their successful acceptance into the Promotion under the Quota Cap.
  1. Engagement Period
    1. The Engagement Period means the period commencing on the date we countersign the Eligible Agreement (Engagement Start Date) and continuing until the engagement is terminated in accordance with the Eligible Agreement or these Promotion Terms.
    2. For the avoidance of doubt, any time prior to the Engagement Start Date (for example, initial discussions) does not form part of the Engagement Period.
  1. Satisfaction Guarantee – Retainer Refund
    1. Subject to clauses 5.2 – 5.6 of these Promotion Terms, if an Eligible Client:
      1. has not entered into a binding contract to purchase a property during the Engagement Period; and
      2. validly exercises the Satisfaction Guarantee within the time and in the manner described in this clause, we will refund the $50 (incl. GST) retainer fee paid under the Eligible Agreement.
    2. To exercise the Satisfaction Guarantee, the Eligible Client must:
      1. give us written notice (by email to mitch@brysonba.com.au) clearly stating that they wish to cancel their engagement under the Promotion and request a refund of the retainer; and
      2. ensure that such notice is received by us at any time during the Engagement Period, prior to entering into a binding contract to purchase a property.
    3. Upon valid exercise of the Satisfaction Guarantee:
      1. the Eligible Agreement will be taken to be terminated with effect from the date we receive the client’s notice (or such other date agreed in writing);
      2. we will have no ongoing obligation to provide any services to the client under the Eligible Agreement; and
      3. we will refund the $50 (incl. GST) retainer to the client within 7 business days, by electronic funds transfer to the same account from which payment was made, unless otherwise agreed.
    4. The Satisfaction Guarantee is limited to a refund of the $50 (incl. GST) retainer only. It does not:
      1. entitle the client to any refund of commission or success fees, or waive, release, or diminish the client’s liability to pay commission or success fees where a Presented Property is subsequently purchased in accordance with clause 7 and the Eligible Agreement; or
      2. affect any other fees or third‑party costs properly incurred on the client’s behalf (for example, building and pest reports, strata or title searches, legal fees, or other professional services), which remain the client’s responsibility.
    5. A client may only exercise the Satisfaction Guarantee once in relation to any single Eligible Agreement. The Promotion cannot be combined with any other promotional offer, discount or rebate, unless we expressly agree in writing, and only to the extent permitted by law.
    6. Nothing in these Promotion Terms limits or affects any rights or remedies a client may have under the Australian Consumer Law, including rights to a refund, replacement or compensation where consumer guarantees are not met.
  1. Purchase During Engagement Period – Full Value Deemed Delivered
    1. If an Eligible Client enters into a binding contract to purchase a property during the Engagement Period, this will be deemed to reflect full value of our services (pursuant to the relevant Engagement Agreement) for the purposes of the Promotion.
    2. Where clause 6.1 applies:
      1. the Satisfaction Guarantee will no longer be available and the client will not be entitled to a refund of the retainer under the Promotion; and
      2. the Eligible Agreement (including all standard terms and conditions relating to commission and other fees) will continue in full force and effect according to its terms.
    3. For the avoidance of doubt, a client who has exchanged contracts on a property within the Engagement Period cannot subsequently exercise the Satisfaction Guarantee, even if settlement occurs after the end of that period or the contract later rescinds, except to the extent required by law.
  2. Commission Payable on Purchases After Promotional Period
    1. The Promotion and any refund of the retainer does not waive or extinguish our entitlement to commission or other fees under an Eligible Agreement in circumstances where:
      1. at any time during the Engagement Period, we have introduced, recommended or presented a property to the client (Presented Property), whether during or after the Promotional Period; and
      2. within 12 months after the expiry of the Promotional Period (i.e. on or before 30 November 2027), the client (or any related party or nominee of the client) enters into a binding contract to purchase that Presented Property.
    2. In the circumstances described in clause 7.1, the commission and any applicable success fees will remain payable in full in accordance with the Eligible Agreement, notwithstanding that:
      1. the client exercised the Satisfaction Guarantee or received a retainer refund;
      2. the Eligible Agreement has terminated; or
      3. the contract for the Presented Property is entered into after the Promotional Period.
  1. Client Obligations During the Engagement Period
    1. To remain eligible for the Satisfaction Guarantee, the client must, during the Engagement Period:
      1. provide accurate and complete information in relation to their property requirements, budget, finance status and timing;
      2. be reasonably available to review opportunities and respond to our communications within 72 hours, or such other period agreed in writing;
      3. attend, or use best endeavours to attend, property inspections or other appointments arranged with their approval; and
      4. not unreasonably refuse to consider properties that materially meet the agreed search criteria
    2. If the client materially breaches the Eligible Agreement or these Promotion Terms, or unreasonably frustrates the search process, we may, acting reasonably, determine that the client is no longer eligible to exercise the Satisfaction Guarantee. In that case, the Promotion will cease to apply, but the Eligible Agreement will otherwise continue according to its terms, subject to any rights the client has under the Australian Consumer Law.
  1. Exclusions and Limitations
    1. The Promotion does not apply to:
      1. commercial, industrial or rural property searches;
      2. vendor advocacy or sales agency services;
      3. any engagement where we have expressly notified the client in writing that the Promotion does not apply;
    2. To the maximum extent permitted by law:
      1. our total aggregate liability to a client arising out of or in connection with the Promotion is limited to the amount of the retainer paid by that client under the Eligible Agreement; and
      2. we exclude all conditions, warranties, guarantees and representations not expressly set out in these Promotion Terms or the Eligible Agreement, other than those that cannot be excluded under the Australian Consumer Law or any other applicable law.:
    3. Nothing in these Promotion Terms operates to exclude, restrict or modify any non‑excludable rights or remedies under the ACL or any other applicable law.
  1. Privacy
    1. Any personal information we collect in connection with the Promotion will be handled in accordance with our Privacy Policy, as amended from time to time, and applicable privacy laws.
    2. By participating in the Promotion, the client consents to us collecting, using and disclosing their personal information for the purposes of administering the Promotion, providing services under the Eligible Agreement, and for related marketing purposes (unless the client opts out), in accordance with our Privacy Policy.
  1. General
    1. These Promotion Terms form part of, and are to be read together with, the Eligible Agreement. If there is any inconsistency between these Promotion Terms and the Eligible Agreement, the Eligible Agreement will prevail to the extent of the inconsistency, except where prohibited by law.
    2. We may vary these Promotion Terms from time to time by posting an updated version on our website. Any such variation will apply only to engagements entered into after the updated Promotion Terms are posted, unless otherwise required by law or expressly agreed in writing with the client.
    3. The Promotion and these Promotion Terms are governed by the laws of New South Wales law. The parties submit to the non‑exclusive jurisdiction of New South Wales.
    4. If any provision of these Promotion Terms is held to be invalid, unlawful or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
